Johnson And Johnson Hip Replacement Lawsuit Payouts

Johnson will be paying  $2.5 billion in the ASR and Pinnacle . hip implant settlements

NEW YORK (Reuters) – A unit of Johnson & Johnson has agreed to pay an estimated $2.5 billion to settle thousands of lawsuits from individuals allegedly injured by the company's artificial hip implants, the company announced Tuesday.

The settlement, announced during a hearing in federal court in Ohio on Tuesday, would compensate an estimated 8,000 patients who underwent surgery to replace their hip implants, according to a statement from Johnson & Johnson unit Depuy Orthopaedics Inc and DePuy Hip Replacement  lawyers for the victims.

al The company was defending more than 12,000 lawsuits in U.S. state and federal court over injuries allegedly caused by its metal-on-metal ASR hip-replacement systems, according to a regulatory filing.

Depuy recalled the ASR hip system in 2010, after data suggested that it failed at a higher-than-expected rate. At the time, the company had sold about 93,000 systems worldwide.

Metal hip implant systems like Depuy's ASR hips were designed to be more durable, replacing a traditional metal-on-plastic ball-and-socket design. Instead, some patients who received the ASR hips reported experiencing pain, swelling, joint dislocation and sometimes damage to the central nervous system, thyroid and heart.

The settlement would compensate plaintiffs who have undergone surgery to replace their hips as of August 31, 2013, the company said Tuesday. The company estimated that 8,000 plaintiffs would be eligible.

There is no cap on the amount of individual claims, according to Peter Flowers, one of the lead lawyers for the plaintiffs. Eligible U.S. plaintiffs can seek compensation for costs associated with their revision surgery, as well as payments of qualified liens by healthcare providers associated with the surgery, Flowers said.

You Can Opt To Continue The Lawsuit and Not Accept The Offer

Plaintiffs who opt not to participate in the program, or those who have not undergone revision surgery to replace their implants, will continue to litigate.

The company said it will continue to defend itself in the remaining lawsuits not resolved by the agreement. It also said that it expected the cost of the settlement program to be covered by reserves it had previously set aside, and did not expect to record an additional charge in connection with the agreement.

"The U.S. settlement program provides compensation for eligible patients without the delay and uncertainty of protracted litigation," said Andrew Ekdahl, president of Depuy Synthes Joint Reconstruction, in a statement.

The settlement is not subject to court approval, according to a Johnson & Johnson spokeswoman, Lorie Gawreluk.

The announcement comes just weeks after Johnson & Johnson announced it would pay $2.2 billion to resolve civil and criminal probes into its marketing of several medications, including the anti-psychotic drug Risperdal.

The Ethicon subsidiary is also a defendant in more than 23,000 lawsuits over vaginal mesh implants, according to a quarterly filing with the U.S. Securities and Exchange Commission.

It has become apparent that there is a large number of drugs and devices class actions that have been filed against manyfacturers that have targeted women.

We can start with the Dow Corning  siicone  breast implant class action of years ago.  Women are still suffering today.        History moves along to the metal on metal and metal componednt hip replacements like the  DePuy Pinnacle and ASR Hip Replacement and the Stryker Rejuvinate and ABG II Modular Stems. These are  a metal on metal hip replacement recalled for their  need for revision surgery. These hip replacements failed  in women more then men. The  smaller frame of a women makes the device more prone to problems in the female structure.

DePuy Hip Replacement Lawsuit Update

DePuy ASR lawsuit claims stemming from the 2010 DePuy hip recall continue to move forward in courts throughout the country . According to documents filed in California’s San Francisco Superior Court on April 25th, a Plaintiff who had been seeking an expedited trial of her DePuy hip lawsuit is voluntarily seeking dismissal of the case. (Tilman v. DePuy Orthopaedics, Inc., et al., No. CGC11508806; Calif. Super. Ct., San Francisco).

This news is particularly interesting as when a case is voluntarily dismissed it is often an indication that the parties have come to an agreement. 

DePuy ASR Hip Lawsuits Lawyers Filing DePuy Lawsuits

Court records indicate that there are more than 10,000 DePuy ASR hip lawsuits currently pending in courts throughout the U.S. The DePuy hip recall was announced after the metal-on-metal hip implants were found to be failing in an unacceptably high number of patients. The U.S. Food & Drug Administration (FDA) is now reviewing the safety of all metal hip implants, over fears that the devices can shed dangerous amounts of metal debris into patient’s bodies, leading to premature failure of the hips and other serious complications. In January, the agency proposed a new regulation that would make such devices ineligible for the agency’s 510(k) clearance process, which allowed all-metal hips like the ASR hip to gain FDA approval without first undergoing human clinical trials. The FDA also advised doctors to test metal hip implant patients for elevated metal ion levels if they present with symptoms of a failing hip implant.*

The majority of DePuy hip lawsuits have been filed in a multidistrict litigation now underway in U.S. District Court, Northern District of Ohio. Court records indicate that the first trials in that litigation will begin this September. (In re: DePuy Orthopaedics, Inc. ASR Hip Implant Products Liability Litigation – MDL 2197) Two lawsuits have already gone to trial at the state level, one of which ended with a California Superior Court jury awarding the Plaintiff more than $8 million in damages. (Kransky v. DePuy, BC456086, California Superior Court, Los Angeles County) However, the jury hearing a second trial in Illinois state court found for DePuy. (Strum v. DePuy, 2011-L-9352, Circuit Court of Cook County) According to an April 16th report from The New York Times, documents submitted as evidence in both of those trials indicated that Johnson & Johnson and its DePuy Orthopaedics unit knew that the ASR was flawed years before the recall was announced, but did not disclose this information to the public or the medical community.**

Earlier this month, DePuy Orthopaedics announced it would end sales of metal-on-metal hip implants, citing recent FDA actions and decreased demand for the products, according to the New York Times. The sales suspension includes a metal-on-metal version of the company’s DePuy Pinnacle hip replacement system, which is also the subject of lawsuits.

Stryker Rejuvinate and ABG Modular II Stems Hip Replacement

The U.S. Judicial Panel on Multidistrict Litigation is considering  forming an MDL to handle the growing number of Stryker lawsuits. Both the Rejuvenate and the ABG II hip implants were recalled in July 2012. This was done due to  reports that  the implants were  causing  complications including loosening of the joint, corrosion, and increased risk of inflammation as well as metal toxicity.  Many  victims of these  failed devices have had to undergo revision surgery to remove and replace them long before they reached the end of their expected 15-20 year lifespan. On March 18, 2013, Stryker filed a brief with the JPML, agreeing that coordination of lawsuits involving the recalled devices was appropriate.

Yaz Lawsuit

Yaz class action lawyers  are accepting Yaz cases for blood clots, stroke, pulmonary embolism and untimely death of young women.

As of February 12, 2013, Bayer had reached agreements, without admission of liability, to settle the claims of approximately 4,800 Yaz victims  in the U.S. for a total amount of about US$1 billion," according to the annual report.

Bayer also said that it, "is only settling claims in the U.S. for venous clot injuries (deep vein thrombosis or pulmonary embolism) after a case-specific analysis of medical records on a rolling basis. Such injuries are alleged by about 3,200 of the pending unsettled claimants. Bayer will continue to consider the option of settling individual lawsuits in the U.S. on a case-by-case basis.

New Hip Replacement Rcall, Adept Hip Replacement Recalled

Johnson and Johnson has recalled another hip replacement due to the failure yet. This is another hip replacement recall which can be added to the long list of the DePuy ASR, DePuy Pinnacle, Stryker Rejuvinate, Stryker ABG II and the Zimmer Duram Cup are all hip replacement components recalled fro failure rates.
 

While Johnson & Johnson is  facing mounting litigation over its DePuy ASR and DePuy Pinnacle hip replacements,  the company has issued another metal-on-metal hip replacement  recall.  The “Adept” line of an all-metal hip replacement system because of higher than expected failure rates has been recalled.

The company recalled the 7,500 Adept metal hip implants that were sold between 2004 and September 2011. The implants were sold in Germany and 20 other countries, though not in the U.S. A U.K. joint registry found that the Adept hip implants had a 12.1 percent seven year revision surgery rate. An Australian registry found a 7.1 percent three year failure rate.

Sounds familiar? In August 2010, J&J issued the ASR hip recall that affected 93,000 worldwide and caused thousands of patients to suffer from serious adverse effects and hip replacement failure. Data from the U.K. joint registry showed a 12 percent failure rate, though according the company’s more recent estimates, the DePuy ASR hip replacement’s five year failure rate may be nearly 40 percent.

DePuy Pinnacle Lawsuits


More than 3,000 DePuy Pinnacle hip replacement lawsuits have been filed in the federal litigation underway in Texas. While no recall has been issued for the metal-on-metal Pinnacle device, Johnson & Johnson and its DePuy Orthopaedics unit did announce a recall for the metal-on-metal ASR hip implant in August 2010.  The  devices were found to have a high failure rate. The  DePuy Pinnacle lawsuits are based on the fact that the  metal-on-metal version causes high levels of metal levels , early implant failure and other complications.  The federal Pinnacle litigation will continue through December 2013, with the first trials scheduled to begin in September 2014.

The Stryker Hip Replacemant

The Stryker ABG II modular-neck stem and Stryker Rejuvinate

The Stryker ABG II modular-neck stem is a new type of multi-piece hip replacement system. When it was approved, the company claimed that its many interchangeable parts made it ideal for matching each patient’s unique biomechanics.
Although the Stryker ABG II is technically a plastic-on-ceramic hip implant, the device has a unique neck/stem junction that is a metal-on-metal design. Like other metal-on-metal hip implants (including the DePuy ASR, which was recalled in 2010), the Stryker ABG II was fast-tracked through the FDA’s approval process via the 510(k) system. The FDA allows manufacturers to avoid conducting long-term safety studies of new devices so long as they are “substantially similar” to existing devices
Stryker ABG II Recall

Stryker first warned orthopedic surgeons about the risks of the ABG II hip implant in an Urgent Field Safety Notice that was sent in May 2012. The warning advised doctors to be aware of the following severe side effects associated with the ABG II hip implant:

Excessive corrosion at the neck joint, which could shed toxic nano-particles into the patient’s body
Pain, inflammation, tissue damage, and swelling caused by toxic metal nano-particles
Allergic reaction, especially in patients with metal sensitivity
Osteolysis (dissolving bone loss) caused by metal nano-particles

What is a Bellwether case?

It meets the needs of thousands of plaintiffs all injured by a particular product or group of products. The courts cannot handle thousands of trials. There is no other feasible way for the courts to handle this enormous caseload. The 2013 big bellwether cases going to trial are the  vaginal mesh and DePuy hip replacement. This approach has been used in many cases including asbestos, mesothelioma cases.. A group of plaintiffs are chosen to represent all the plaintiffs.  The verdicts from this group is  used for   the remaining plaintiffs’ cases. The actual results may be utilized for setting a value for  groups of claims in settlements. The plaintiffs can also choose to continue with their own individual trials with their own attorney.

Important Bellwether Trials for 2013

Vaginal Mesh

The first bellwether trials in the Transvaginal Mesh MDL (Multidistrict Litigations) are scheduled to start at the end of 2013.

A status conference for  five vaginal mesh implant lawsuit MDLs was called on December 6, 2012 to announce the first three bellwether trials that will begin in December of 2013. The U.S. District Judge that is overseeing the trials in the Southern District of West Virginia, Judge Joseph R. Goodwin, has scheduled the three bellwether trials which will involve three different vaginal mesh implant manufacturers as defendants.

  • American Medical Systems
  • Ethicon 
  • Boston Scientific.

These "bellwether" trials should give women, and attorneys, a better idea of the viability of their lawsuits and the basis for compensation. Four of the multi-district litigations (MDL) around the country will begin this year, with the earliest starting this month in New Jersey. Another MDL in West Virginia is set to begin in February.

DePuy Hip Replacement

The first DePuy Hip Replacement  trial  is scheduled to begin on Monday, January 7, 2013, in Prince George's Maryland Circuit Court. The trial is expected to last three weeks, according to court documents. (Jackson, et al. v. Chesapeake Surgical Ltd., et al., CAL 10-32147)

Judge David Katz of the U.S. District Court, District of Northern Ohio has scheduled the first bellwether trials in the DePuy Orthopaedics, Inc. ASR Hip Implant Products Liability Litigation(MDL No. 2197) for May 6, 2013 and July 8, 2013.

The DePuy metal on metal hip replacement is currently in the ligation process. The DePuy is a part of a long line of metal on metal hip recalls, the most recent being the Stryker metal component hip replacements. As the trials progress executives will be questioned as to knowledge of the potential failure of these devices.

Executives that will be questioned  include David Floyd, former president of DePuy at the time of the 2010 recall; Tom Camino, worldwide hip development director; and Rodrigo Diaz, manager of clinical research. Additional executives include the director of marketing, manager of development, director of biostatistics and data management, and member of the research and development team.

The DePuy is a part of a massive multi distrct litigation effecting 1000's of people with a hip implant that failed. Most of them will require additional surgeries with rehabilitation. The problem appears to be that these revision surgeries are not always working. Many people, mostly seniors, have been severely debilitated by these failed hips and their quality of life will never be the same again. Additional problems include metal on metal chromium and cobalt toxicity.

The most recent updates report that  Judge Brian R. Martinotti of Bergen County Superior Court in New Jersey issued an order setting September 9, 2013 and October 21, 2013 as the dates for the first two ASR bellwether trials to be held in the state’s multicounty litigation against DePuy Orthopaedics. Attorneys for both sides must select three cases as bellwether trial candidates by October 15, 2012.

The latest news on the Stryker Rejuvinate recall reports that Stryker has warned in its recall notice that patients with the Rejuvenate or AGB II hip implant components may develop adverse  reactions that could manifest with symptoms of pain and/or swelling.* According to a  recent report  it appears eight  people  have filed lawsuits in New Jersey Superior Court, Bergen County claiming Stryker  sold their  Rejuvenate hip stem while knowing it had problems. The Stryker also appears to be having the same metal on metal toxicity problems as the DePuy even thou it is a metal component and not metal on metal product.

Class action lawyers announce another DePuy recall: DePuy Hip replacement and custom joint implants

DePuy Orthopaedics is being forced to recall yet another line of hip and other artificial joint implants. This time, the Johnson & Johnson subsidiary is pulling back its custom orthopedic devices because of U.S. Food and Drug Administration (FDA) safety concerns. The recall notice was issued on August 24 — two years after its ASR hip-implant recall.

DePuy agreed in January 2012 to stop manufacturing the custom devices after a warning letter from the FDA. In it, the agency said the implants were being sold without federal approval, which requires an application with the FDA and clinical trials. DePuy argued that the devices were exempt because they were already approved by the FDA and modified only by doctors’ prescriptions, which is permitted by law.

But the FDA disagreed: “Although the devices’ size and shape may vary with each patient’s anatomy, the standardized design characteristics do not vary among the devices manufactured. The fact that final specifications are tailored to match a patient’s anatomy does not preclude a clinical study or submission of a marketing application for the devices.”

The FDA also said DePuy used poor quality-control systems in the production of the 14 types of custom implants. It ordered the company to recall any implants that had been delivered to surgeons prior to the halt in manufacturing earlier this year. More than 8,300 customized DePuy implants have been sold since 1999, but the number of unused devices in the recall is unknown.

DePuy already is dealing with a massive global recall of 93,000 ASR hip-replacement and hip-resurfacing devices that was announced in August 2010. The defective metal-on-metal hip implants have been shown to fail within a few years, resulting in painful revision surgeries. Typically, all-metal hip implants are expected to last about 15 years.

In addition, the DePuy artificial hips produce metal shavings when the ball and socket components grind against each other, causing metallosis, or metal poisoning of the blood. One British study found that when the metal debris becomes embedded in surrounding tissues, it increases the patient’s risk of bladder and kidney cancers.

In the United States, more than 8,000 patients have filed lawsuits against DePuy over their dangerous hip implants. Of those, 6,000 federal cases are part of a multidistrict litigation (MDL) that is being overseen by Judge David A. Katz in the U.S. District Court for the Northern District of Ohio. The first case in the MDL is expected to go to trial in March or April 2013.

The remaining state cases are winding their way through the courts. The first three DePuy ASR lawsuits, which were scheduled to be tried together in Las Vegas, Nevada, were settled out of court recently. Bloomberg reported the plaintiffs each received about $200,000.

DePuy ASR Metal on Metal Hip Replacement Settlements  Have Begun. DePuy Hip Replacement Lawyers Take Notice As Lawsuit Filing

J&J’s DePuy unit recalled its 93,000 ASR hips worldwide in 2010, including 37,000 in the U.S., after finding that more than 12 percent of the devices failed within five years.

According to the allegations in filed lawsuits, both in federal and state courts, many patients are in pain and immobilized by joint dislocations, infections and bone fractures and have to undergo painful and expensive hip replacement surgeries.

. Problems with the ASR systems include:

    Devices becoming loose or dislocated
    Small metal particles flaking off and getting into surrounding tissues, causing pain and inflammation
 

Patients suing J&J, allege that metal debris is released by the grinding of artificial metal hips, and causes local tissue death around the joint and may increase metal cobalt and chromium ions in the bloodstream.

New Settlement News

Johnson & Johnson (JNJ), which faces about 8,000 lawsuits over hip implants it recalled in 2010, agreed to pay about $600,000 to resolve three cases in the first settlements of the litigation, people familiar with the accords said.
